TOWN OF CONCORD PLAN COMMISSION MINUTES
June 25, 2025
The meeting was called to order at 7:00 p.m. with Plan Commission members Sally Williams, Tony Metzger, Dave Wegner, Dale Konle, and Duwayne Hunt present. Town chair Ted Mueller and Town supervisor Kim Miller were also present.
Sally Williams stated that the meeting had been properly posted.
Tony Metzger made a motion to approve the minutes from the May 28, 2025 meeting, second by Dale Konle. All approved. Motion passed.
Item 1: Request by Steve Sawvell for Conditional Use Permit for Storage of Construction Equipment and Materials and for a 20’ addition to the west end of the existing building at N6487 Elm Dr. The property is .6 acres and was rezoned to A-2 in 1986. Sawvell Roofing has a permit to store personal non-farm equipment issued in 1989 and has been using the property for almost 40 years to store equipment for their roofing business. The county has asked him to update the CUP to storage of construction equipment. There are approximately 4 -6 employees that come to the site for about ½ hour around 6:45 am and again sometime after 5 pm to pick up and unload equipment and materials.

Clayton Chase, N6493 Elm Dr., sent an e-mail outlining his issues with the current use of the property. He lives in the residence to the north which he purchased in 2018. He cited “problems of noise nuisance, heavy equipment noise, vehicle back up alarms, porta potty use without servicing, constant traffic, traffic at any time of the day, commercial dumpster use, etc… The hours of operation mentioned are more than often not the case. Often they arrive at 6:30am and proceed to empty their mobile dumpster into the larger dumpster which is often loud due to materials and the opening/closing slamming of the mobile dumpster doors. Instances of loud unloading metal materials at 6:30-7 am often occur. Rarely are operations done by 5pm. Often there are instances of working (loading/unloading materials, running heavy equipment and back up alarms at 7-8-9 pm. Often employees, Sawvell, jobsite material deliveries, and dumpsters are coming and going throughout the day.”

Chelsea Chase, N6493 Elm Dr., was present and voiced the same complaints, primarily excessive noise.

Carol Chase, mother of Clayton, the business is a nuisance to the surrounding residences. She doesn’t feel this should be allowed in an agricultural zoning.

Dave Wegner spoke to the other neighboring residences and none of them had any complaints.
Mr. Sawvell will work directly with the Claytons to discuss the situation and address their concerns.
Dave Wegner made a motion to recommend approval of the CUP and 20’ addition to the building, second by Tony Metzger. All approved. Motion passed.
Item 2: Discussion of Town Ordinances Ch. 18.1 Impact Fees
No action taken. Plan Commission is waiting for direction from the town board.
Item 3: Discussion of Town Ordinances Ch. 25 Construction and Effect of Ordinances
This chapter has penalty provisions for many of the other ordinances which would be enforced via citations. This necessitates the ability of the town to specify a court and date at which the citation could be contested. Kim Miller will contact the Towns Association and Jefferson County Circuit Court to see how the town would go about establishing what court would hear such cases.
Item 4: Discussion of annexation
There was discussion of statutes regarding annexation, purchase of development rights, and becoming a village.
There was agreement that if the town wants to pursue options to protect against annexation, a municipal attorney or planning consultant should be hired to answer our questions and potentially guide us through the whatever process we choose to pursue. The Town Board will address this at their next meeting.
With no further business Tony Metzger made a motion to adjourn, second by Dale Konle. Meeting adjourned at 8:37 p.m.
